This policy explains what personal data we collect through nigelcasey.com, why we collect it, who we share it with, and what you can ask us to do about it.
It is written to be read rather than survived. If anything in it is unclear, ask us and we will explain it.
1. Who we are
This website is operated by Digital Professionals Academy Sagl, registered in the Register of Commerce, Lugano, and based in Torricella, Canton Ticino, Switzerland.
For the purposes of applicable data-protection law, including the Swiss Federal Act on Data Protection (FADP) and, where it applies, the EU General Data Protection Regulation (GDPR), Digital Professionals Academy Sagl is the controller of the personal data described in this policy unless stated otherwise.
2. What this policy covers
This policy covers nigelcasey.com and the assessment and diagnostic tools we operate at dashboard.nigelcasey.com.
Our language-learning services run under a separate policy at englishfluency.online. Where you use both, each policy applies to its own service.
3. What personal data we collect
Information you give us
There is no account and no login on this website. You only give us personal data when you choose to.
- your name, email address and telephone number when you book a call through the booking widget
- the details you enter into a diagnostic, assessment or enquiry form, including information about your business
- the content of any message you send us by email, LinkedIn or through a form
- anything you tell us during a call, and any notes we take from it
Information collected automatically
- technical data such as IP address, browser type, device type, language and referring page
- usage data such as the pages you viewed, when, and for how long
- measurement data collected by the marketing pixel described in section 6
- server logs kept by our hosting provider for security and reliability
We do not ask for special categories of personal data on this site, and you should not send them to us in a form or a message.
4. Why we use your personal data
- to respond to your enquiry and arrange, hold and follow up a call
- to prepare and deliver a diagnostic, assessment or proposal you asked for
- to provide and administer any services you go on to buy
- to operate, secure and improve this website
- to understand which content and campaigns are working
- to send you information about our services where you have asked for it or where we are otherwise permitted to

5. Legal bases for processing
Depending on where you are and which law applies, we rely on one or more of the following:
- performance of a contract with you, or steps taken at your request before entering one
- compliance with a legal obligation
- our legitimate interests, where those are not overridden by your rights and freedoms
- your consent, where consent is required
Our legitimate interests include operating and securing the website, understanding how it is used, communicating with people who contact us, and marketing our services proportionately.
6. Cookies, pixels and similar technologies
This site uses a small number of technologies that store or read information on your device:
- the booking widget, which needs to function in order to show available times and take your booking
- a Meta advertising pixel, which measures whether visits and enquiries follow from our advertising and lets us reach comparable audiences
- storage used by our hosting provider for performance and security
You can control or block these through your browser or device settings. Blocking the booking widget will stop it from loading; blocking the marketing pixel does not affect how the site works for you.
7. How we share personal data
We do not sell your personal data. We share it only with the categories of recipient needed to run the business:
- website hosting and content delivery providers
- our customer relationship, scheduling and email platform, which also powers the booking widget
- database and storage providers
- advertising and measurement platforms, for the pixel described above
- video meeting platforms, when you join a call
- artificial intelligence providers, where a tool you have asked us to run processes the information you submitted
- professional advisers such as lawyers, accountants and auditors
- authorities, regulators or courts where we are legally required to
- a buyer, investor or their advisers in connection with a sale, financing or restructuring of the business

8. International data transfers
We are based in Switzerland and hold the bulk of our data with providers located in the European Union, which the Swiss Federal Council recognises as offering an adequate level of protection.
Some providers, including our advertising measurement and parts of our hosting and customer relationship platform, are located in the United States, which is not on the Federal Council's adequacy list. For those transfers we rely on the following safeguards, in line with Articles 16 and 17 FADP:
- the recipient's participation in the Swiss-U.S. Data Privacy Framework, where it is enrolled
- Standard Contractual Clauses approved or recognised by the Swiss Federal Data Protection and Information Commissioner, where it is not
- where relevant, the transfer being directly connected with performing a contract with you

9. How long we keep it
We keep personal data only as long as reasonably necessary for the purposes set out above, including to run the relationship, meet legal, tax and accounting obligations, resolve disputes and maintain business records.
Enquiries that do not lead to work are reviewed periodically and deleted when they are no longer relevant. Records connected to a paid engagement are kept for the retention periods Swiss law requires. When data is no longer needed we delete it or anonymise it.
10. Security
We take appropriate technical and organisational measures to protect personal data, including access controls, encryption in transit, multi-factor authentication on administrative systems and separation between our public website and our internal systems.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Your rights
Depending on where you are, you may have the right to:
- ask what personal data we hold about you and how it is processed
- receive a copy of it
- have inaccurate or incomplete data corrected
- ask us to delete data
- ask us to restrict or object to certain processing
- withdraw consent where processing is based on it
- receive certain data in a portable format
- object to a decision based solely on automated processing, where that applies
To exercise any of these, contact us using the details in the final section. We may need to verify your identity first. If you are unhappy with how we handle your request, you can complain to the Swiss Federal Data Protection and Information Commissioner, or to your local supervisory authority if you are in the EU or the UK.
12. Marketing
Where permitted, we may send you information about our services. Every marketing email carries an unsubscribe link, and you can also ask us to stop at any time. Even after you opt out we may still send messages needed to run a service you have asked for, such as confirming a booking.
13. Artificial intelligence on this site
Our diagnostics and assessments use artificial intelligence to analyse the information you submit and to produce a report. Where that happens, the information you entered is sent to the model provider that performs the analysis.
We do not use the personal data you send us to train third-party foundation models. Outputs are generated automatically and should be read as informed analysis rather than professional advice. A human reviews anything that forms the basis of a recommendation to you.
14. Other websites
This site links to other websites, including our own dashboard, our language-learning platform and social networks. This policy does not cover them, and we are not responsible for their practices. Read their policies separately.
15. Children
This site and our consulting services are intended for businesses and for adults. We do not knowingly collect personal data from children through this website.
16. Changes to this policy
We may update this policy to reflect changes in the site, the services, our providers or the law. When we do, we update the date at the top of this page. Where a change is material we will give additional notice if it is appropriate to do so.
